Fifth Circuit Sides with SXSW in Appeal of Insurance Loss

The U.S. Court of Appeals for the Fifth Circuit has sided with South by Southwest (SXSW) in its appeal of insurance loss related to COVID-era cancellations. The Fifth Circuit’s decision returns the case to the lower courts to determine how much Federal Insurance Company owes SXSW under its insurance policy. According to previous coverage of the case, the dispute is the first Directors and Officers (D&O) Liability Insurance case over pandemic-related event cancellations to reach a federal appeals court.
