In November, we mentioned the new FLSA regulations would not be released until late 2016, due to the number of comments received. Still even now, the publication date is questionable. While the Department of Labor(DOL) speculates July as the release date, there is still much to be done.

The review process is lengthy and at this rate, the rule could be rejected by a new Congress under the Congressional Review Act(CRA). Although the CRA has only been used successfully once before, it is a possibility to consider. Even without a definite release date, Employers may want to plan ahead and evaluate how these changes will affect their workforce and what options they have to minimize the financial impact.
